臺灣臺北地方法院刑事簡易判決114年度審簡字第1850號公 訴 人 臺灣臺北地方檢察署檢察官被 告 朱紹嘉上列被告因違反跟蹤騷擾防制法案件，經檢察官提起公訴（114年度偵字第16216號、第14023號、第15594號），嗣被告於本院審理時自白犯罪（114年度審易字第1698號），本院認為宜以簡易判決處刑，逕以簡易判決處刑如下：
主 文朱紹嘉犯跟蹤騷擾防制法第十八條第一項之跟蹤騷擾罪，處拘役伍拾日，如易科罰金，以新臺幣壹仟元折算壹日。又犯跟蹤騷擾防制法第十九條之違反保護令罪，處有期徒刑貳月，如易科罰金，以新臺幣壹仟元折算壹日。
事實及理由
一、本件犯罪事實及證據，除證據部分增列「被告朱紹嘉於本院審理時之自白」外，其餘均引用起訴書之記載（如附件）。
二、論罪科刑
(一)核被告所為，係犯跟蹤騷擾防制法第18條第1項之跟蹤騷擾罪及同法第19條之違反保護令罪。
(二)按跟蹤騷擾防制法第18條第1、2項之跟蹤騷擾罪，係處罰行為人實行同法第3條第1項所稱之跟蹤騷擾行為，而所謂跟蹤騷擾行為，依同法第3條第1項規定，又係以行為人對特定人「反覆或持續」實行跟蹤騷擾行為為前提。該要件判斷除以時間上的近接性為必要，並就個別具體事案之樣態、緣由、經過、時間等要素為是否持續反覆的評斷。立法者既已預設跟蹤騷擾行為具有反覆實行之特性，顯然本罪之成立，本身即具有集合犯之特性。從而，被告自113年12月5日起至114年3月20日止、自113年12月4日起至114年3月4日止，分別以如起訴書附表一、二所示之方式跟蹤騷擾告訴人，主觀上各係基於單一犯意所為，故被告上揭所為應構成集合犯，僅各論以一罪。
(三)被告就起訴書附表四、五所示部分，係以一行為同時觸犯跟蹤騷擾防制法第18條第1項之跟蹤騷擾罪、同法第19條之違反保護令罪，為想像競合犯，依刑法第55條前段之規定，從一重以違反保護令罪處斷。
(四)按集合犯固因其行為具有反覆、繼續之特質，而評價為包括之一罪，然並非所有反覆或繼續實行之行為，皆一律可認為包括之一罪，而僅受一次評價，故仍須從行為人主觀上是否自始即具有單一或概括之犯意，以及客觀上行為之時空關係是否密切銜接，並依社會通常健全觀念，認屬包括之一罪為合理適當者，始足以當之。尤以行為經警方查獲時，其反社會性及違法性已具體表露，行為人已有受法律非難之認識，其包括一罪之犯行至此終止，若經司法機關為相關之處置後，猶再犯罪，則其主觀上顯係另行起意而為，客觀上其受一次評價之事由亦已消滅，自不得再以集合犯論(最高法院 112年度台上字第540號判決意旨參照）。查被告既已於114年3月27日知悉並收受如起訴書附表三所示本案保護令內容，則被告知悉本案保護令後所為如起訴書附表四、五所示行為，主觀上顯係另行起意而為，是被告所犯上開2罪，犯意各別，行為互異，應予分論併罰。
三、爰以行為人之責任為基礎，審酌被告未能尊重他人人際界線，竟為滿足自身私慾，違反告訴人之意願，跟蹤騷擾告訴人，致告訴人心生畏怖，影響其日常生活及社會活動，所為應予非難，惟考量被告犯後坦承犯行之犯後態度，暨斟酌被告之智識程度及家庭生活經濟狀況、其犯罪動機、目的、手段、所生損害程度等一切情狀，分別量處如主文所示之刑，及諭知易科罰金之折算標準。
四、依刑事訴訟法第449條第2項、第3項、第454條第2項，逕以簡易判決處刑如主文。
五、如不服本件判決，得自收受送達之翌日起20日內，向本院提起上訴。

犯罪事實
一、朱紹嘉前曾受代號AW000-K113421成年男子(下稱A男，真實姓名詳卷)教授2堂鋼琴課，詎朱紹嘉為表達愛慕之意，竟基於實行跟蹤騷擾行為之犯意，反覆、持續違反A男意願，於附表一、二所示時間、地點，對A男為如附表一、二所示之跟蹤騷擾行為，使A男心生畏怖，足以影響其日常生活或社會活動。嗣A男檢具前述事證向臺灣臺北地方法院聲請核發跟蹤騷擾保護令後，經該院於114年3月20日以114年度跟護字第1號核發跟蹤騷擾保護令(下稱本案保護令)，裁定朱紹嘉不得對A男為附表三所示本案保護令內容之行為，保護令有效期間為2年，詎朱紹嘉於114年3月27日知悉並收受本案保護令內容後，再基於實行跟蹤騷擾行為及違反本案保護令之犯意，仍反覆、持續違反A男意願，於附表四、五所示時間、地點，對A男為如附表四、五所示之跟蹤騷擾行為，使A男心生畏怖，足以影響其日常生活或社會活動，並違反本案保護令之規定。
二、案經A男訴由臺北市政府警察局中正第二分局及大安分局報告偵辦。
證據並所犯法條
一、證據清單及待證事實：編號 證據名稱 待證事實 1 被告朱紹嘉於警詢及偵查中之供述 坦承有於附表一、二、四、五所示時間，對A男為附表一、二、四、五所示行為之事實。 2 證人即告訴人A男於警詢及偵查中之指訴 證明全部犯罪事實。 3 臺北市政府警察局中正第二分局書面告誡 證明被告於113年12月20日已收到違反跟蹤騷擾法之書面告誡，仍持續對A男為跟蹤騷擾行為之事實。 4 中正第二分局照片黏貼紀錄表及影像光碟1片(見114年偵字第14023號卷) 證明被告有為附表一編號5所示行為之事實。 5 告訴人所提供被告於附表一編號1、附表二及附表四編號2、編號五所示時間寄送之郵件及電子郵件各1份 證明被告為表達愛慕之意，有於如於附表一編號1、附表二及附表四編號2、編號五所示時間，寄送給告訴人如附表一編號1、附表二及附表四編號2、編號五所示內容之郵件及電子郵件之事實。 6 臺北市政府警察局刑案照片黏貼紀錄表1份(114年偵字第16216號卷宗) 證明被告有為附表四、五所示行為之事實。 7 本案保護令1份 證明被告經臺灣臺北地方法院於114年3月20日裁定，命被告不得對告訴人為附表三所示行為，該保護令有效期間為2年等事實。 8 被告114年3月30日民事抗告狀暨附錄證據1份 證明被告於114年3月27日收受本案保護令並知悉本案保護令所限制之內容。 9 告訴人提供與友人之對話紀錄截圖 證明被告行為使A男心生畏怖，且影響告訴人日常生活及社會活動之事實。
二、核被告所為，係犯跟蹤騷擾防制法第18條第1項之實行跟蹤騷擾行為罪嫌；附表四、五所列行為另犯跟蹤騷擾防制法第19條之違反跟蹤騷擾保護令罪嫌。被告於附表一、二之犯行，係出於同一騷擾之目的，且依跟蹤騷擾防制法規定行為應有反覆性及持續性，應認被告之行為，為接續之一行為，請依接續犯論以包括一罪；又附表四、五所載之犯行，則係出於同一騷擾及違反保護令之目的，其行為同具反覆性及持續性，為接續之一行為，並以一行為同時觸犯違反跟蹤騷擾保護令及實行跟蹤騷擾行為2罪，為想像競合犯，請依刑法第55條規定，從一重論以違反跟蹤騷擾保護令罪處斷之。至被告附表一、二與附表四、五之犯行，客觀上可由法院核發本案保護令進行切割，被告經接獲本案保護令後再為類似行為，堪認犯意各別且行為互殊，請予分論併罰。
